WEBSITE TERMS & CONDITIONS

My Estate Sorted
Last updated: 18 August 2026

These Terms and Conditions govern your use of the My Estate Sorted website and your purchase and use of products, digital resources and other services made available through the website.

By using this website or purchasing from us, you agree to these Terms and Conditions.

1. About My Estate Sorted

My Estate Sorted provides Estate Planning Organizers, educational information, resources and related products designed to help individuals organise and record Essential Life Information.

2. Important Disclaimer

My Estate Sorted products, website content, reports, quizzes, checklists and other resources are provided for general organisational, informational and educational purposes.

They do not constitute legal, financial, taxation, medical, accounting or other professional advice.

My Estate Sorted does not replace a Will, Power of Attorney, Enduring Guardian arrangement, trust, insurance policy or other legal or financial document.

Where appropriate, you should obtain advice from a suitably qualified professional regarding your individual circumstances.

3. Products and Product Information

We make reasonable efforts to ensure product descriptions, photographs, specifications, prices and other information displayed on our website are accurate.

Colours and appearance may vary depending on your device, screen settings, printing processes and product variations.

We may update, modify or discontinue products from time to time.

4. Orders

When you place an order through our website, you are offering to purchase the selected products subject to these Terms and Conditions.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

  • a product is unavailable;
  • pricing or product information contains a genuine error;
  • payment cannot be authorised;
  • fraud or unauthorised activity is suspected; or
  • we cannot reasonably fulfil the order.

If payment has already been received for an order we cannot fulfil, the applicable amount will be refunded.

5. Prices and Payment

Prices will be displayed on the website in the currency indicated at checkout.

Applicable taxes, shipping charges and other costs will be shown where required before an order is completed.

Payment must be made using one of the payment methods available through our checkout.

Payments may be processed by third-party payment providers and may also be subject to the provider's terms and privacy policy.

6. International Orders

My Estate Sorted may make products available to customers outside Australia.

International customers are responsible for ensuring products may lawfully be imported into their destination country and for any customs duties, import taxes or other charges imposed by local authorities, unless otherwise stated during checkout.

International delivery times may vary due to customs, postal services and circumstances outside our reasonable control.

7. Shipping and Delivery

Estimated delivery times displayed on our website are estimates only unless expressly stated otherwise.

We will take reasonable steps to dispatch orders promptly, but delivery may be affected by postal services, couriers, customs, weather and other matters outside our reasonable control.

Customers are responsible for providing complete and accurate delivery information.

8. Returns, Refunds and Consumer Rights

Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Products supplied by My Estate Sorted come with consumer guarantees that cannot be excluded under Australian Consumer Law.

If a product is faulty, damaged, incorrectly supplied or otherwise fails to meet applicable consumer guarantees, please contact us so that an appropriate remedy can be arranged.

Any additional change-of-mind returns policy offered by My Estate Sorted will be displayed on our website and operates in addition to, not instead of, rights available under applicable consumer law.

This distinction matters: ACCC guidance specifically warns businesses against return terms that suggest statutory consumer rights are limited by a business's own return policy.

9. Digital Products and Free Resources

We may provide downloadable reports, checklists, guides or other digital resources.

Unless otherwise stated, these resources are provided for personal, non-commercial use only.

You may download and print them for your own use but may not reproduce, sell, commercially distribute, republish or modify them for commercial purposes without our written permission.

10. Quizzes and Assessments

Any quiz, score or assessment provided by My Estate Sorted is intended as a general educational and organisational tool.

Results are indicative only and should not be interpreted as professional advice, certification that your affairs are complete, or confirmation that your estate planning arrangements are legally adequate.

A high score does not guarantee that your affairs are complete or that all relevant information, documents or assets have been identified.

11. Your Responsibility for Information

The usefulness of an Organizer or other My Estate Sorted resource depends upon the information entered, maintained and updated by the user.

You are responsible for:

  • deciding what information to record;
  • ensuring information is accurate and current;
  • updating information when circumstances change;
  • storing your Organizer and information securely; and
  • deciding who should know where it is located or have access to it.

We strongly recommend that passwords, PINs and other highly sensitive access credentials are managed securely and appropriately.

12. Intellectual Property

Unless otherwise indicated, the My Estate Sorted name, branding, website content, organizer content, reports, graphics, photographs, illustrations, quizzes, checklists, resources and other materials are owned by or licensed to My Estate Sorted and are protected by applicable intellectual property laws.

You may not reproduce, modify, distribute, sell, publish or commercially exploit our content without prior written permission, except as permitted by law.

13. Website Use

You must not use our website:

  • unlawfully;
  • fraudulently;
  • to interfere with the operation or security of the website;
  • to introduce malicious software;
  • to attempt unauthorised access to systems or information; or
  • to infringe our rights or the rights of another person.

14. Third-Party Websites and Marketplaces

Our website may link to third-party websites and marketplaces, including Amazon.

Purchases made through a third-party marketplace are also subject to that platform's applicable terms, policies and procedures.

My Estate Sorted is not responsible for the operation, availability or content of third-party websites.

15. Testimonials and Reviews

Testimonials, reviews or customer experiences displayed on our website reflect individual experiences and do not guarantee that every customer will have the same experience or outcome.

16. Limitation of Liability

To the maximum extent permitted by law, My Estate Sorted is not liable for losses arising solely from a person's reliance on general educational or organisational information provided through the website or our resources where that information was not intended to constitute professional advice.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded or limited.

That final sentence is particularly important because Australian businesses cannot simply disclaim statutory consumer rights or reasonably foreseeable losses arising from failure to meet consumer guarantees.

17. Changes to These Terms

We may update these Terms and Conditions from time to time.

The version applying to a purchase will generally be the version published on our website when the order was placed, subject to applicable law.

18. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws of Australia.

Nothing in this clause limits any rights a consumer may have under mandatory laws applicable in their place of residence.
